Movest BidSafe Report – Terms and Conditions

 

Acceptance

By ordering a Movest BidSafe Report, you agree to these Terms and Conditions and confirm that you understand and accept the scope, fees, and limitations described below.


1. About Movest

Your report is provided by Movest for Base Law Limited.

  • Stacey Graves, Solicitor and Joss Orum, Legal Executive are responsible for delivering the service.

  • By ordering, you become a client of Base Law Limited.

  • Services are provided in accordance with the Lawyers and Conveyancers Act 2006 and the Rules of Conduct and Client Care for Lawyers.

  • Our Terms of Engagement sets out the standard terms (terms) on which Base Law provides legal and related services to clients.  Subject to any other agreement that we reach in writing, the terms will apply whenever you instruct us to act on any matter.  Your continued instructions to us confirms your acceptance of the terms.  If you have any queries on any of the terms contained in our TOE, we are happy to discuss them further with you.


2. What’s Included in Your BidSafe Report ($399 incl. GST)

The report covers legal review of:

  • Standard LIM report

  • Standard ADLS Auction Agreement

  • Standard fee simple freehold title (without complex instruments)

The report provides:

  • Advice on auction terms and conditions

  • Review of title and LIM matters

  • General advice on finance, insurance, and conditions relevant to bidding

Please note:

  • Non-standard agreements, complex titles, multiple instruments, or urgent requests may incur additional fees. This will be notified to you at commencement of work.

  • Missing documents may require extra searches (e.g., title searches) charged separately at cost.

  • LIMs and building reports are relied on as provided by vendors/agents. For certainty, independent verification is recommended.


3. Fees & Additional Charges

BidSafe Report: $399 incl. GST

  • Extra services: Charged separately (e.g., complex titles, urgent requests, additional searches)

  • Identity verification / AML checks: Charged separately

  • Follow-on Conveyancing:

    • Required if you proceed with the purchase

    • Standard fee (further to BidSafe Report fee) to complete transaction to settlement: $1,900 + GST + disbursements + administration fee

    • Disbursements may include title transfer, mortgage registration, bank fees, and PPSR searches

  • Hourly rates for non-standard matters/extra advice:

    • Stacey Graves: $450/hr + GST

    • Joss Orum: $350/hr + GST

Payment:

  • No upfront payment required to order the report

  • Payment will be due for your BidSafe report following the auction if you are unsuccessful. If you are successful and proceed with our services further, your fee will be payable upon settlement.

  • We will confirm your details before commencing work


4. Identity Verification & AML Compliance

To comply with the Anti-Money Laundering and Countering Financing of Terrorism Act, we must verify your identity.

  • By ordering your report, you consent to electronic identity verification.

  • We will email you a link to complete your online verification.

  • Verification charges are additional to our quoted fees.


5. Your Responsibilities

To help us complete your report, you agree to:

  • Provide accurate property details

  • Supply requested identification for AML verification

  • Respond promptly to follow-up questions about the property

  • Pay our fee upon completion of your matter


6. Limitations & Liability

The report is limited to advice on documents provided by the agent.

From a legal perspective, the documents are provided by the Vendor and their Agent in good faith. However, Builders' reports usually provide a disclaimer on their contents and can only be relied on by the Vendor unless you make an arrangement with the Building Inspector concerned to readdress the report to you should you be the successful buyer.

Likewise, a LIM provided to a Vendor cannot be relied upon by a Purchaser as to its contents. Although it would be very unusual for a LIM to be missing relevant information it can happen and the issuing Council does not owe a duty to a third party as to the accuracy of the contents of the LIM.

In terms of both LIMs and Builders reports; the only safe way to ensure you are covered for omissions, accuracy or the like is to commission your own build report and LIM.

Please note under no circumstances are we providing any form of advice in  relation to the tax position of your transaction. Tax issues including but not  limited to Goods and Services Tax, Tax on properties (Brightline test),  Resident Withholding Tax or any other Tax related matter (“Tax”) are  expressly excluded from our services. We are not Tax experts and do not  purport to have any specialist knowledge in this regard. 

Accordingly, any Tax obligation is your sole responsibility and obligation,  and we recommend that as to your Tax position you should obtain specialist  independent Accounting and\or Legal Tax advice as it relates to your  circumstances if you are in any doubt whatsoever. Whilst a transaction may  involve the imposition of Tax and we may seek GST or IRD numbers or  related Tax information and/or prepare a tax invoice on your behalf, this is  solely for the purpose of advancing settlement of the transaction and is in  no way a representation as to the suitability or correctness of your Tax  position implied or accepted by Base Law Limited. Accordingly,  all liability in relation to your tax matters, payment obligations or associated liability is expressly excluded and you indemnify and hold Base Law Limited harmless in relation to your tax related matter(s). 


10. Acceptance

By submitting your order:

  • You confirm you have read and accept these Terms and Conditions

  • You consent to AML identity verification

  • You agree to continue with Movest for conveyancing if you proceed with the purchase

  • You will pay the fees we invoice you for
